Preamble

PDC, Psychology, Development and Online Recruitment, Ltd., a commercial partnership with Tax ID 515773603, is the company holding the MindFirst brand, with commercial headquarters at Lagoas Park, Building 7, Floor 1, 2740-244 Porto Salvo.

This document aims to establish the terms of access and use of the MindFirst platform, determining the respective conditions of use.

Henceforth, all references made to the MindFirst platform shall be referred to as MindFirst.

Henceforth, all references made to citizens using the platform shall be referred to as Users;

Henceforth, all references made to citizens providing services through the platform shall be referred to as Professionals;

 

Art.1

Condition of access

Access and navigation to MindFirst depends on acceptance of the following principles:

1 - When accessing MindFirst for purposes of exploring content or accessing services, Users expressly declare their full agreement with the terms and conditions provided in this document.

2 - When accessing MindFirst for purposes of exploring content or accessing services, Users expressly declare their informed consent, in accordance with the agreement published on the MindFirst platform.

3 - In these terms, acceptance of the Terms and Conditions of Use of the MindFirst Platform and the expression of informed consent correspond to the declaration, by the User, that they are informed, and explicitly accepting the operating conditions of MindFirst.

4 – MindFirst reserves the right to alter, at any time, in whole or in part, the Terms and Conditions of Use of the MindFirst Platform contained in this site, without any need for prior notice.

Art. 2º

Capacity for Access

1 – All citizens with equipment with internet access have access to MindFirst.

2 – Citizens aged 18 years or older have access to registration on MindFirst for the purpose of contracting the available services.

3 – Citizens under 18 years of age also have access to registration on MindFirst for the purpose of contracting the available services, provided they are explicitly authorized by citizens with parental or legal responsibility.

4 - Express consent for the use of the services mentioned in the previous number by customers under 18 years of age is given through the sending, by electronic mail, of a written declaration, dated and signed, in accordance with the model in use, sent to geral@mindfirst.pt.

5 – In the case of access to counseling or therapy sessions, the Professional may make the session conditional on the presence of the citizen with parental or legal responsibility of the minor.

6 – The absence of a citizen with parental responsibility in the session of a minor User, when required by the Professional, may result in the cancellation of the session without any obligation to refund the amount paid.

 

Art. 3

Available services

1 - MindFirst provides Users with an organized set of services, structured as follows:

 

1.1. - In the field of Psychology:

a) Counseling Sessions;

b) Therapy Sessions;

1.2. - In the field of Well-being:

a) Nutrition Consultations

b) Mindfulness Sessions;

c) Yoga Sessions;

1.3. - In the field of training:

a) Coaching Sessions

b) Training Conferences;

c) Training Courses;

d) Other events relating to topics of health, development and training;

2 - The provision of the services mentioned in the previous number presupposes acceptance of these terms and conditions, as well as the specific conditions that may be determined by the professionals, which will always be subject to prior information to Users.

3 - All Terms and Conditions of Use of the MindFirst Platform are subject to the laws in force in the Portuguese Republic, as well as to the ethical and deontological standards of the professional service providers.

 

Art. 4º

Use of data

1 – The User, by agreeing to these Terms and Conditions of Use of the MindFirst Platform, declares themselves receptive to contacts that may be made by MindFirst within the scope of the company's activity.

2 – For the purposes of the previous number, these contacts include those relating to the scheduling or conduct of sessions, evaluation of services and professionals, follow-up of customers after the fact, and dissemination of initiatives within the scope of MindFirst's activity.

3 – Users may, if they wish, request clarification on the use of personal data, through the email address geral@mindfirst.pt

4 - Data collected within the scope of MindFirst's activity is handled in accordance with the provisions of the Privacy and Security Policy available for consultation on this site and always in compliance with applicable community and Portuguese legislation.

 

Art. 5º

Rights of MindFirst

MindFirst reserves the following rights:

1 - To suspend or terminate, permanently or temporarily, partially or wholly, at its discretion or as needed and at any time, the platform in use, without prior notice.

2 - To claim intellectual property ownership over all content contained in MindFirst, across multiple platforms, except those that derive from links to external sites and others whose sources and authorship are properly indicated.

3 – The rights mentioned in the previous number include those relating to the structure of the site, texts, films, photographs, logos.

 

Art. 6º

Duties of MindFirst

For the purposes of developing the activity and relationship with Users, the duties of MindFirst are:

1 - To verify the academic capacity and professional qualification of professionals providing services through the platform.

2 - To ensure compliance with applicable ethical and deontological standards and to respect technical guidance issued by entities responsible for regulating the professional activities operating through MindFirst.

3 - To provide the technological resources necessary to conduct the contracted acts, under conditions that allow the conduct of effective sessions for the user.

4 - To develop necessary actions to guarantee information security.

5 - To provide all clarifications legitimately presented by Users.

6 - To refund amounts paid for services that may eventually be canceled, in accordance with this document.

 

Art. 7º

Rights of the User

In the interaction they establish with MindFirst, the User benefits from the following rights:

1- To access professionals registered with MindFirst, with a guarantee of their correct qualification and training for their respective areas of activity.

2- To be compensated in the event of non-performance of a scheduled session due to technical issues not attributable to the User and attributable to MindFirst, in accordance with this document.

3- To claim, at any time, the right to be forgotten and to delete the data provided, except in cases where, by force of law, the preservation of such data is mandatory.

 

Art. 8º

Duties of the User

For the purposes of navigation, registration and access to services provided through the MindFirst platform, the duties of the User are:

1- To provide true and updated information whenever requested by professionals, through registration and administrative services, as well as other interactions that may operate through MindFirst, assuming responsibility if the accuracy and truthfulness of the data is not verified.

2- To provide true and accurate information for the purpose of billing for services provided by MindFirst.

3- To safeguard access data to the platform, maintaining appropriate confidentiality over them, which are personal and non-transferable.

 

4- To interact with professionals, verbally or in writing, using appropriate language.

5- To ensure the technical conditions for access to services provided by MindFirst, namely equipment and internet service, without which MindFirst will not be responsible for inability or deficiency in access.

6 - To use the technological capabilities made available by MindFirst exclusively for the purposes for which they were made available.

7- To respect intellectual property rights regarding MindFirst content.

 

Art. 9º

Scheduling and conducting sessions

1 – The conduct of consultations is preceded, sequentially, by the following acts on the part of the client:

  1. Completion of registration;

  2. Declaration of agreement and acceptance of the Informed Consent, Terms and Conditions of Use of the MindFirst Platform, and Terms of the Privacy and Security Policy.

  3. Selection of the professional;

  4. Completion of scheduling;

  5. Completion of payment.

2 – After payment is made, the Client is notified by email of the confirmation of the payment and the conduct of the consultation.

3 – If necessary, the client may request to reschedule the session, with a minimum of 24 hours' notice.

4 – In case of cancellation, the amount paid may be refunded, provided that this is communicated at least 24 hours before the session is to be held.

5 – For the purposes of numbers 3 and 4 of this article, failure to observe the 24-hour notice period results in no refund of the amount paid.

6 – On the scheduled date and time, the link to access the video conference system is sent to the User. Sequentially, the User and the Professional access the platform and begin the respective session.

7 – If the User does not appear for the session at the indicated time, a tolerance of 15 minutes will be granted, after which the session will be canceled, with no right to refund of the amount paid.

8 – If the User does appear for the session, even if late, it will take place in the remaining time for conducting the session, considering the originally scheduled time.

9 – If there is any delay on the part of the Professional, the client may claim a refund of the amount paid, in which case the session will be canceled.

 

Art. 10º

Payments and refunds

1 - Payments made by Users for contracted services will be made through the means made available by MindFirst;

2 - Payment is made in advance and must be made up to 24 hours before the consultation/session is held. Only with the effective completion and receipt of payment will the session be effectively confirmed.

3 – The User may proceed with the cancellation of the scheduled session up to 24 hours before the start time.

4 – Cancellation of the session as mentioned in the previous number generates a service credit for the same amount, on a date to be determined, depending on the availability of the User and the Client.

5 – In the event of non-performance of a scheduled session due to technical issues not attributable to the User, the User has the right to a new scheduling or full refund of the amount previously paid.

6 – There is no refund of the amount paid by the user in the event of non-performance of a scheduled session due to technical or other issues attributable to the User.

 

Art. 12º

Processing of Personal Data

1 – MindFirst scrupulously complies with the applicable Portuguese and community legal regimes regarding data processing and protection.

2 – MindFirst makes appropriate efforts to preserve information security and safeguard data against potential cyber attacks.

 

Art. 13º

Provision of data

MindFirst may only make data provided by the User available if the national authority with competence to do so determines it.

 

Art. 14º

Disclaimer

1- MindFirst is not responsible for damages or irregularities committed by third parties willfully and which may constitute a crime, namely by usurpation of identity or illegal access to data.

2 - MindFirst is not responsible for service weaknesses resulting from the use of outdated technology by the User.

3 - MindFirst is not responsible for technical deficiencies attributable to others, namely by energy and internet service providers, which are essential for the normal functioning of services.

4 – MindFirst is not responsible for the contents of external sites accessible through links available on this platform, nor does it endorse their contents, and their use is the exclusive responsibility of Users.

 

Art. 15º

Copyright

1 - All content constituting the MindFirst platform is property of MindFirst, Psychology, Development and Online Training Services, Ltd., with its rights reserved in accordance with the law.

2 – MindFirst, Psychology, Development and Online Training Services, Ltd. reserves the right to take action against any agent of any violation or abuse that may be committed regarding the usurpation of intellectual property.

 

Art. 16º

Litigation and governing rules

1- All services provided through MindFirst are subject to Portuguese and European Union legislation.

2- In case of divergence or litigation, proceedings will be initiated before the competent Portuguese judicial institutions.

 

Art. 17º

Final Provisions

1 – The framework of all matters not explicitly set out in these Terms and Conditions of Use of the MindFirst Platform will be subject to applicable Portuguese and community legislation, to the regulatory and guiding provisions of the regulatory bodies of the professions that exercise activity on the platform.

2 - The Court of Sintra is hereby designated to settle any disputes arising from the relationship established within the scope of MindFirst.
